1. Whimsical Charms has the right to change the TOS at any time without prior written notice. This includes restricting or denying further service to you or your company. When possible you will be given fair warning via the email you have provided Whimsical Charms with.


2. You are required to purchase from Whimsical Charms at least once every 90 days. Failure to do so may result in your account being terminated without notice due to inactivity.


3. In order to activate your account you are required to either email or fax a valid State Resell Permit, Sales and Use Tax ID, a Certificate of Authority or similar document.  The name of this document will vary from state to state. 
   


4. Use of our titles and pictures will be used responsibly. No HOTLINKING is allowed!! You will be provided with pictures that you may use on your website, but they must be saved on your computer and then uploaded to your own server. Hotlinking is grounds for immediate termination of your account.


5. All item descriptions must be written in your own words on your website. This helps protect both mine and your website's SEO standings since Google has a no duplicate content policy.


6. All applicants must provide a valid mailing address, telephone number and email address.  You agree to keep this information up to date.


7. Your reseller pricing is confidential and not to be shared with anyone else. 
   


8. Items listed in The Whimsical Collection do not qualify for wholesale pricing at this time.  These items will sometimes be listed in two categories, so if they are found in the second category, they will still NOT be discounted.  You can always tell if the item is discounted because when you are logged in you will see your dropship / wholesale discount % right above the order box on the product page.
   


9. You may only sell Whimsical Charms' products in the retail store or website listed on your application.  Our products may NOT be listed on eBay, Etsy, websites with "adult" content or similar sites.


10. You agree to the return policy listed on our website, www.whimsicalcharms.com.


11. Due to state and federal laws our jewelry is intended for those 13 years of age and older.  You may not market Whimsical Charms to those that are 12 years and younger.


12. Whimsical Charms will ship your items in a timely manner.  Due to the nature of some of our charms taking up to 4 days to cure, most charms are shipped out in 5-7 days (7-10 days for wholesale orders).  This time will be longer for larger wholesale orders.


13. Slight variations on most of our jewelry is to be expected since Whimsical Charms & Other Jewelry Designs are handcrafted by a person (usually me) in Long Beach, CA and I am not a machine.  This adds to the beauty and uniqueness of the jewelry.


14. You may not market Whimsical Charms as your own.  You do not have to mention our name, but it is encouraged.  Choices for mentioning our name is as follows: Whimsical Charms, Whimsical Charms & Other Jewelry Designs and WC Designs (to keep the name semi-private on your website).


15. All orders are shipped via USPS with e-delivery confirmation.  You will be provided with the number.  Remember, the e-delivery confirmation is a delivery confirmation service by the USPS, not a tracking number.  Orders may not show up in their system until they have been delivered.
